PREAMBULE MED PARTNER INTERACTIVE SARL is a company specialized in the field of Health, particularly through the distance selling of products for comfort, care and hygiene delivered exclusively in Metropolitan France, Corsica and Monaco.
The company MED PARTNER INTERACTIVE SARL sells its products remotely either via the Internet (www.pied-main.fr site or e-mail), or by telephone or by post. The sale of products offered by the company MED PARTNER INTERACTIVE SARL can also be done via its thematic paper catalogs or press announcements. PAYMENT DEFAULT The Company MED PARTNER INTERACTIVE SARL reserves the right to refuse to make a delivery or to honor an order from a customer who has not paid in whole or in part a previous order or with whom a dispute is being administered.
RETENTION OF TITLE The company MED PARTNER INTERACTIVE SARL remains the owner of the goods delivered until their full payment by the customer. The above provisions do not preclude, upon delivery of the goods, the transfer to the customer of the risk of loss or deterioration of the goods subject to retention of title as well as the damage they may cause. INVOICE The order form that the customer establishes online does not constitute an invoice. PREPARATION TIME Orders placed by Internet, telephone or postal mail are collected from Monday to Saturday and shipped in less than 24 hours for a product that the company has in stock, paid by credit card, cash on delivery or bank or postal check. Payment by bank transfer leads to an increase in the time of invoicing due to the processing time and the bank's validation time (5 days). TRANSPORT TIME
The products are sent by priority letter followed or Colissimo followed allowing delivery in 48 hours (generally 24 hours in the Paris region). DELIVERY TIME MED PARTNER INTERACTIVE SARL has the product in stock, the delivery time is equal to the preparation time of the order plus the transport time. LOSS OF PARCEL
Parcels sent by MED PARTNER INTERACTIVE SARL are tracked. If the tracking indicators indicate the absence of delivery, in this case, MED PARTNER INTERACTIVE SARL is obliged to respect the deadlines imposed by La Poste or by the carriers concerning the declaration of loss and the refund of the shipment. In fact, the customer is also bound by these deadlines: - Thus, he has a maximum period of 10 working days from receipt of the email confirming the shipment of his package to declare it lost to MED PARTNER INTERACTIVE SARL. Beyond this period no claim will be taken into account.
- On the other hand, if the customer has declared his lost package within the period explained above, MED PARTNER INTERACTIVE SARL takes care of opening a complaint file. In this context and it is therefore possible that it asks the client for the documents necessary for the constitution of this file.
- Finally, the final answers concerning the surveys are given by the carriers within a period varying from one to three weeks. The answer can be of two types: either the package is found and it is then returned to the customer according to the normal procedure, or the package is declared lost by the carrier and MED PARTNER INTERACTIVE informs the customer and proceeds to the refund (invoiced amount) or makes a second shipment at the customer's choice.
RECEIPT OF THE PACKAGE Any product delivered must be subject to control and possible reservations on the carrier's slip in case of partial or total deterioration. Without reservation, the product is deemed to be delivered in good condition and can not be the subject of any subsequent dispute. Any unclaimed parcel returned to MED PARTNER INTERACTIVE SARL may be redirected at the recipient's expense.
DELIVERY ERROR Upon receipt of the package by the customer, he must formulate by telephone, fax, e-mail or postal mail to MED PARTNER INTERACTIVE SARL any claim of non-conformity of the products in kind, quality or quantity compared to the indications on the invoice. In the event of a strike by La Poste services, carriers or any other event of an exceptional nature slowing down or preventing the delivery of parcels, MED PARTNER INTERACTIVE SARL will make every effort to inform the customer of the status of the shipment of his package.
RIGHT OF WITHDRAWAL: SATISFIED PROCEDURE OR REFUND Existence If for any reason whatsoever the customer is not satisfied with the product he has purchased, Article L121-20 of the Consumer Code states that he has the possibility to renounce his purchase within 7 days of receipt of his package. The product must be returned in perfect condition for resale, that is to say, packed in its original packaging, complete and showing no trace of shock or malfunction. For reasons of hygiene, this condition does not apply to orthotics.
CONDITIONS A product is understood as a whole; Thus, if the customer has ordered a pack and is not satisfied with one of the components of the pack, he must still return the entire pack. MED PARTNER INTERACTIVE SARL reserves the right to return incomplete packages to the customer. MODALITIES OF EXERCISE The customer must inform the Pied-main.fr company (SARL Med Partner Interactive) of his prior intention to return the package. It can do this by e-mail, telephone, fax, or postal mail. Subject to compliance with the previous conditions, a refund of the value of the products in accordance with the purchase invoice, excluding shipping costs, will be made within 30 days of receipt of the product by PIED-MAIN.FR (SARL Med Partner Interactive). In any case, Pied-main.fr (SARL Med Partner Interactive) reserves the right to charge the price of consumed, damaged or missing products. WARRANTY Most of the products sold by MED PARTNER INTERACTIVE SARL are contractually guaranteed by their respective manufacturer. The warranty contract is concluded between the customer and the manufacturer by the act of purchase, the purchase invoice. LEGAL GUARANTEES
The customer benefits from the legal guarantee described in Article L211-1 of the Consumer Code which includes Articles 1641 to 1648 of the Civil Code. As a reminder this guarantee is due by the seller under 4 conditions: - that the defect of the product is hidden - that it is prior to the conclusion of the sales contract - that it is important to such an extent that the customer would not have bought it or would have offered a lower price - that the action is brought within a short time from receipt of the package RESPONSABILITE MED PARTNER INTERACTIVE SARL is released from its obligations of Delivery in case of force majeure.
